By creating a Pixly account or using the Service, you agree to these Terms. If you do not agree, do not use Pixly. These Terms apply to all users, including Shopify merchants and developers accessing Pixly via the API.
Age requirement: You must be at least 18 years old to create an account or use Pixly. By using the Service, you confirm that you meet this requirement.
2. Description of Service
Pixly is a SaaS platform that uses artificial intelligence to analyze, rename, convert, and optimize product images for Shopify stores. Core features include AI-generated alt text and filenames, WebP conversion, 1:1 square cropping, Shopify media sync, and Auto-Pilot automation.
AI Usage Terms
AI-generated content is suggestions, not guarantees. Alt-text, filenames, and quality assessments generated by our AI are proposals for your review. Pixly does not warrant their accuracy, completeness, or fitness for any specific commercial purpose.
You retain ownership. All AI-generated metadata applied to your product images belongs to you. Pixly claims no ownership over your content or the AI output applied to it.
You are responsible for final review. You agree to review AI-generated content before publishing it to your Shopify store. Pixly is not liable for SEO impact, search ranking changes, or marketplace policy violations arising from AI-generated content you approve and publish.
No training on your data.Your product images are not used to train Pixly's models or any third-party model. Images are sent to our AI provider only for analysis and are not used to train models under our provider agreement.
3. Accounts and Tokens
You must provide a valid email address and maintain the security of your password.
Free accounts receive 69 tokens every month at no charge. Unused free tokens do not roll over to the next month.
Paid subscriptions grant a monthly token allowance based on your plan (see Pricing). Monthly subscription tokens do not roll over to the next billing period.
Token top-ups add tokens to your balance; top-up tokens follow the same usage rules below.
How tokens are charged
Action
Token cost
AI analysis (alt text + SEO filename per image)
1 token per image analyzed
WebP conversion and 1:1 square crop
Included in analysis (no extra charge for standard processing)
AI upscale (low-resolution images only, when enabled)
+4 tokens per upscaled image (in addition to the 1 analysis token)
Background removal (when enabled)
+3 tokens per image (in addition to the 1 analysis token)
Example: one image with analysis, upscale, and background removal enabled costs 1 + 4 + 3 = 8 tokens total.
Auto-Pilot (Growth and Scale plans only) deducts tokens automatically according to your store settings and daily caps (100 images/day on Growth Semi-Auto; up to 500 images/day on Scale, configurable). See Pricing and in-app Auto-Pilot settings.
When tokens are not charged or are refunded
If AI analysis fails for an image before results are delivered, tokens for that image are refunded to your balance.
If upscaling fails during processing, the 4-token upscale charge for that image is refunded.
If background removal fails during processing, the 3-token background removal charge for that image is refunded.
If a processing run is interrupted by a system error before completing charged work, unused tokens for that run are refunded where technically possible.
Token refunds are credits to your Pixly balance, not cash refunds.
Consumed tokens
Once tokens are successfully consumed for a completed service (analysis delivered, or processing completed without a qualifying failure), those tokens are non-refundable, except as required by applicable consumer law or our subscription refund rules in Section 6.
Pixly may suspend accounts that abuse the free tier, automate circumvention of limits, or violate these Terms.
4. Shopify Integration
By connecting your Shopify store, you authorise Pixly to read product data and upload media on your behalf using the permissions you grant during the OAuth flow.
You are solely responsible for ensuring that content synced to your Shopify store complies with Shopify's Acceptable Use Policy and any applicable marketplace rules.
Pixly is an independent tool and is not affiliated with, endorsed by, or sponsored by Shopify Inc.
You may revoke Pixly's access to your Shopify store at any time via the Auto-Pilot settings page or via your Shopify Admin under “Apps and Sales Channels.”
5. Acceptable Use
You agree not to:
Upload images that depict illegal content, non-consensual imagery, or material that infringes third-party intellectual property rights.
Attempt to reverse-engineer, scrape, or abuse the Pixly API or AI pipeline.
Use Pixly to generate misleading or deceptive product descriptions with the intent to defraud consumers.
Share account credentials or use a single account across multiple businesses without an enterprise plan.
6. Payments, Cancellation & Refunds
Paid subscriptions are billed monthly through Shopify Billing. By subscribing, you authorise recurring charges on your Shopify store account.
Cancellation: You may cancel your subscription at any time from your account settings or by emailing hello@getpixly.app. Cancellation takes effect at the end of the current billing period. You retain full access and your remaining tokens until that date.
No partial refunds: We do not provide pro-rata refunds for unused days within a billing period.
New subscription refund window: Refunds are available within 7 days of a new subscription purchase, provided no subscription tokens have been consumed. Approved refunds are credited through Shopify Billing on your store invoice only. Pixly does not refund to external payment methods. Submit a request from Account or email hello@getpixly.app.
Token top-ups: One-time token purchases are non-refundable once any tokens from that purchase have been used.
Token balance refunds (service failures): Section 3 describes when failed AI or processing steps result in tokens being returned to your account balance. That is separate from subscription or payment refunds below.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot be excluded, restricted, or modified.
7. Intellectual Property
The Pixly platform, codebase, UI, and branding are owned by Pixly and protected by copyright. You may not copy, modify, or redistribute any part of the platform without written permission.
Your product images and store data remain entirely yours. We do not claim any rights over them.
8. Data Availability
We take reasonable steps to protect your account and processing data. Product images are stored only for the periods described in our Privacy Policy. Pixly is an optimization service, not a backup or long-term archive. You are responsible for keeping your own copies of critical catalog images.
9. Disclaimer of Warranties
The Service is provided “as is” without warranties of any kind. Pixly does not warrant that AI-generated alt text or filenames will improve your search rankings, comply with any specific accessibility standard, or meet any particular commercial requirement.
10. Limitation of Liability
To the maximum extent permitted by law, Pixly's total liability for any claim arising from the use of the Service is limited to the amount you paid in the 12 months preceding the claim. Pixly is not liable for indirect, incidental, or consequential damages, including loss of revenue or data.
11. Governing Law
These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules. Any disputes shall be resolved in the courts of Victoria, Australia. If you are an EU consumer, you also have the benefit of any mandatory provisions of the law of the country in which you are resident.
12. Changes
We may update these Terms at any time. We will provide at least 14 days' notice via email before any material changes take effect. Continued use of the Service after that date constitutes acceptance.
